Temporary Access Easement. Owner shall maintain safe and free public access to the City Dog Park during the development of the Verde Village Project. Accordingly, prior to physical commencement of infrastructure construction which has the effect of disrupting the existing City access to the Dog Park, Owner shall grant to the City a Temporary Access Easement or Easements for purpose of maintenance of free and unrestricted public access to the City Dog Park. The temporary free access need not be paved but must be sufficiently improved to provide safe access to the Park by the public. Temporary access does not excuse the Owner’s obligation to timely complete the Phase I extension of Xxxxxx to Nevada Street and timely complete the construction of “Canine Way” to the Dog Park, so that City standard access is provided at the earliest possible date. Said Temporary Access Easement shall be provided to the City Legal Department for approval prior to acceptance by the City and recording. The easement shall be in substantially the form set forth in Exhibit H. The precise location of such easement area shall be approved by the City Public Works Director, or designee. The Temporary Access Easement terminates only after conveyance of permanent easements and right-of-way dedications, containing City accepted public infrastructure providing improved public access to the City Dog Park.

Temporary Access Easement. Seller shall and does hereby grant Buyer and its personnel, agents or subcontractors a nonexclusive Temporary Access Easement across the School Site and the Surrounding Xxxxxx Property as necessary to provide access to the School Site to conduct Tests pursuant to Paragraph 7 above. Such easement shall be at such location(s) as will be most convenient for Xxxxx's intended access needs to conduct said Tests.
Temporary Access Easement. The Army, the EPA, and the Commonwealth of Massachusetts, and their respective agents, employees, and contractors, are required to have access to and over the Premises as may be necessary to gain access for personnel, vehicles and equipment to the area lying easterly of the Premises shown on the Level I Plan as Lease Parcel A6A (the “Lease Parcel A6A”). Accordingly, Landlord hereby reserves to itself and all persons claiming by, through or under the Landlord, including the Massachusetts Department of Environmental Protection, the Environmental Protection Agency and the Department of the Army and their agents and employees, a temporary and non-exclusive right and easement in, through, over, under and across the area shown on the Level I Plan as the “Temporary Access Easement”, containing 24,760 square feet according to the Level I Plan, for purposes of vehicular and pedestrian access to Lease Parcel A6A (the “Temporary Access Easement Area”). The Landlord and all persons claiming by, through and under the Landlord as aforesaid shall have the right in common with others to use the Temporary Access Easement Area for all purposes for which private commercial driveways are commonly used, including, without limitation, for purposes of pedestrian and vehicular access over the Premises to Lease Parcel A6A. Evergreen had requested as set forth in the 2008 Easement Agreement to relocate the Temporary Access Easement. The parties acknowledge that the provisions of Section 4 of the 2008 Easement Agreement are no longer applicable as there is no longer a need for said relocation.
Temporary Access Easement. Seller shall grant and assign to Purchaser all of its rights, privileges and options set forth in that certain Temporary Access Easement dated June 27, 2022 and recorded August 3, 2022 as Document No. 2022-024959 in the Office of the Recorder of Lake County, Indiana.
Temporary Access Easement. Owner hereby grants to the City a temporary access easement for ingress and egress over and across property owned by Owner specifically described within “Exhibit A” attached hereto. The City will restore the temporary access easement area to its original condition prior to use of the easement area. All debris or damage to the property created by such access shall be immediately remedied by City at its expense.
Temporary Access Easement. At Closing, the parties shall enter into an easement agreement with respect to a strip of land on the Retained Property between the School Site and Xxxxxx Road (along the portion of the Retained Property currently used as a farm road in the approximate location of the Xxxxxx Road alignment as designated by TGV, subject to District’s approval, not to be unreasonably withheld, conditioned or delayed), to provide a temporary means of ingress and egress to and from the School Site and Xxxxxx Road (the “Temporary Access Easement Agreement”) until a public roadway providing permanent access has been dedicated to and accepted by the City or a reasonable alternative easement is provided to the District. The Temporary Access Easement Agreement shall be substantially in the form of Exhibit G attached hereto or such other form as the parties may agree prior to Closing and will be recorded at Closing.

  • Temporary Space Upon reasonable prior notice from Tenant to Landlord, Landlord agrees to provide Tenant with temporary space (the "Temporary Space") on either the second floor of Building A or the second floor of Building B of a size and in a location to be mutually agreed upon by Landlord and Tenant for a period of time commencing no earlier than sixty (60) days from the date of Tenant's notice requesting that the Temporary Space be made available and expiring on the Commencement Date of this Lease. Tenant's occupancy of the Temporary Space shall be subject to all of the terms and conditions of this Lease to the extent appropriate, except that (i) Annual Fixed Rent for the Temporary Space shall be payable at the annual rate equal to the product of (x) $4.00 and (y) the rentable floor area of the Temporary Space, (ii) for the purposes of determining Tenant's payments on account of Landlord's Operating Expenses under Section 2.6 above and Landlord's Tax Expenses under Section 2.7 with respect to the Temporary Space, the "Rentable Floor Area of the Premises" shall be deemed to be the rentable floor area of the Temporary Space and (iii) the Temporary Space shall be delivered to Tenant in its "as is" condition and no improvement allowance or brokerage commission shall be payable with respect thereto. In addition, it is acknowledged and agreed that if Tenant shall elect to lease any Temporary Space hereunder, Tenant shall be occupying such Temporary Space while Landlord is proceeding with components of the Base Building Work in Buildings A and B and accordingly that Tenant shall use and occupy the Temporary Space in such as manner as to minimize any unreasonable interference with Landlord's performance of the Base Building Work.   • LANDLORD'S ACCESS TO PREMISES Landlord reserves and shall at any time upon reasonable notice and in compliance with Tenant’s reasonable security measures have the right to enter the Premises to inspect the same, to supply any service to be provided by Landlord to Tenant hereunder to service and repair HVAC units, water pipes and sprinkler mains, and electrical and telephone risers servicing other parts of the Building, to show said Premises to prospective purchasers or tenants, to alter or repair the Premises or any portion of the Building, and to place “for sale” or “for rent” signs on the Building, all without being deemed guilty of an eviction of Tenant and without abatement of Rent, provided that the business of Tenant shall be interfered with as little as is reasonably practicable. Tenant hereby waives any claim for damages or any inconvenience to or interference with Tenant’s business, any loss of quiet enjoyment of the Premises and any other loss occasioned thereby.   • Temporary Assignment 11.01 Employees shall perform any temporary work which the management directs with the understanding that when an employee is assigned to a job with a lesser rate of pay, he shall receive his regular rate of pay.

  • Pay on Temporary Assignment An employee temporarily assigned by the Employer to a position with a rate of pay lower than her regular rate of pay shall maintain her regular rate of pay.

  • Temporary Roads As necessary to attain stabilization of roadbed and fill slopes of Temporary Roads, Purchaser shall employ such measures as out- sloping, drainage dips, and water-spreading ditches. After a Temporary Road has served Purchaser’s pur- pose, Purchaser shall give notice to Forest Service and shall remove bridges and culverts, eliminate ditches, out- slope roadbed, remove ruts and berms, effectively block the road to normal vehicular traffic where feasible under existing terrain conditions, and build cross ditches and water bars, as staked or otherwise marked on the ground by Forest Service. When bridges and culverts are re- moved, associated fills shall also be removed to the ex- tent necessary to permit normal maximum flow of water.

  • Occupancy Period The occupancy period begins on the first official day of fall move-in and ends 24 hours after the Student’s last final exam. The contract terms apply to either the full occupancy period (fall and spring semesters), or if entered into after the start of the academic year, to the balance of the occupancy period beginning on the Student’s move-in day. Contracts for graduating seniors shall end at 6pm on graduation day. Housing contracts for summer terms are separate.

  • Temporary Upgrade An employee in a temporary upgrade status shall have no right to grieve or arbitrate release from such temporary upgrade status.

  • Storage Space Tenant shall have the right to occupy approximately 15,000 square feet of space on the lower level of the Building as identified on Exhibit B-1 hereto (the “Storage Space”) to be used for storage in connection with Tenant’s business. The term with respect to the Storage Space shall commence on the date on which Landlord makes the Storage Space available to Tenant (the “Storage Space Commencement Date”) and shall terminate on the Expiration Date. Tenant shall not pay any Fixed Annual Rent for the use of the Storage Space, but except as otherwise provided in this Section 20.27, all of the other provisions of this Lease shall apply as if the Storage Space were a part of the Premises, except that the Storage Space shall not be included in the calculation of Rentable Square Feet for the purpose of determining Tenant’s Share. Tenant shall pay to Landlord as an additional charge for electricity supplied to the Storage Space, an amount determined in accordance with Article 16 of this Lease; provided, however, that if the Storage Space is not separately metered, then such charge shall be equal to Landlord’s actual costs of providing electricity to the Storage Space, as reasonably allocated by Landlord based on a submeter or other reasonable allocation. Landlord shall not be required to provide any services (such as, without limitation, cleaning) to the Storage Space, and the Storage Space shall not be included in calculating Tenant’s Share. Tenant shall accept the Storage Space in its “as is” condition. Tenant shall be permitted to make alterations to the Storage Space at Tenant’s sole expense, subject to the conditions set forth in Article 8 of this Lease, provided that Tenant shall remove any such alterations as directed by Landlord at the termination of this Lease, to the extent that Landlord so requires in accordance with Article 8. Tenant’s right to occupy the Storage Space hereunder is a license otherwise upon the same terms and conditions set forth in this Lease, revocable by Landlord at any time upon the occurrence of an Event of a Default by Tenant under the terms of this Lease, and shall not be construed to be a lease of such space.

  • Temporary Position A temporary position may be established by the employer to provide alternative work for an employee pending an expected suitable vacancy. If the vacancy does not eventuate then the surplus staff provisions will apply.
