Technology Upgrade. a. If, in the event new technology services become available by PRT during the Contract Term of this Agreement, the CUSTOMER may migrate to the new PRTC’s services without penalty. If the CUSTOMER fails to meet the agreed XXXX, during year one of this Agreement, due to migration to a new technology service offered by PRTC, then the Qualifying Conditions and MARC will be reduced by the same percentage as the percent impact of the new technology services.
