TECHNOLOGICAL ADVANCEMENTS. The Client is to refer to hosting and domain name providers for queries regarding the following services: Domain names, Hosting and registration, SSL certificates, Email addresses and Email hosting. The Client is to refer to their technical support company for queries regarding the following services and their applicable Terms & Conditions: Set up of email addresses, Emails going to Spam/Junk, Email not functioning and Email Signatures. XxXxxxx.xx holds no responsibility if: (a) your email addresses are targeted with spam as it is outside of our control or (b) the Client’s email account details are obtained and used to send spam or malicious material. XxXxxxx.xx build and design websites to the best of their knowledge at the time of completion. We shall not take responsibility if the Client’s site is “hacked” or maliciously attacked in form. XxXxxxx.xx will not be held responsible and is not liable for any loss of income to arise from the Client’s web site “going down”, being hacked or otherwise.

TECHNOLOGICAL ADVANCEMENTS. The parties acknowledge that the Services will evolve and be supplemented, modified, enhanced, and/or replaced in the normal course of business during the Term to keep pace with and utilize technological advancements and improvements in the method of delivering IT services.
TECHNOLOGICAL ADVANCEMENTS. ISSC agrees to take reasonable action, taking into account economic circumstances, without an increase in charges to ADVO, subject to the provisions of Section 6.5 and the Performance Standards, to provide the Services to ADVO at a technological level that will enable ADVO to take advantage of technological advancement in its industry. Further, ISSC may, at ISSC's option and expense, implement technological advancements relative to the provision of the Services; provided, however, ISSC continues to perform the Services in accordance with the Performance Standards set forth in this Agreement. Notwithstanding the foregoing, ISSC shall not without ADVO's express consent, and unless only in effect during the Term, implement any technological advancement that materially adversely affects ADVO's ability, at expiration or termination of this Agreement, to migrate to: (i) another technology platform, or (ii) another services provider, or (iii) ADVO itself. If such technological advancement(s) will have an effect on any Baseline(s) and/or ARC/RRC Rate(s) for any resource provided under the Agreement, ISSC will normalize such affected Baseline(s) and/or ARC/RRC Rate(s), consistent with the rebaselining procedures set forth in Schedule J, so that ADVO receives the same level of performance and the same price-performance as provided under the methodology used at inception of this Agreement. ISSC will review with ADVO the conversion methodology (e.g., benchmarking, historical data, etc.) which ISSC used to support such adjustment(s). ISSC will explore the implementation of technological advancements reasonably requested by ADVO.
TECHNOLOGICAL ADVANCEMENTS. Subject to the Change Management Procedures, IBM may, at IBM's option and expense, implement technological advancements relative to the provision of the Services so long as IBM continues to perform the Services in accordance with the Service Levels set forth in this Agreement.

TECHNOLOGICAL ADVANCEMENTS. In the event of a significant and presently unanticipated change in technology that materially reduces ViaSat's costs in providing any of the Services, ViaSat and SAIC agree to negotiate in good faith to change the relevant Service Levels and priced options, as appropriate, to reflect such improvements. Any resulting changes must be implemented through a mutually agreed Change Order.

Confidential treatment has been requested with respect to the omitted portions. DBT or Microgy shall be the sole and exclusive property of DBT. Any such improvements, modifications or other changes or enhancements to the DBT System, the DBT AD Unit or the DBT CHP System any integral hardware components developed by either party shall be licensed to Microgy under the same terms and conditions as set forth in this agreement on an exclusive basis for use in the Licensed Territory and on a non-exclusive basis in all projects developed by Microgy outside of the Licensed Territory that incorporate the DBT System, the DBT AD Unit or the DBT CHP System.
TECHNOLOGICAL ADVANCEMENTS. In order to increase community connection to the rollout of these HIV interventions, CDC begins requiring more state and local-level involvement in the planning of HIV prevention activities, with health departments sharing in the responsibilities of developing and implementing plans. An accompanying CDC report also promises a commitment to “significant community involvement” (CDC 2012, 5). Additionally, CDC recognizes the disconnect between diagnosis and care, noting that out of the 70 percent of people in the United States whose viruses were not under control in 2011, two thirds of them were diagnosed but not in follow-up care (NCHHSTP 2014). The AIDS 2014 Conference releases the recommendation that a “one-size-fits-all” approach to HIV prevention is not suitable, since the populations and geographic regions affected can differ so greatly (International AIDS Society 2014, 7). Improvements in treatment, including the development of effective pre-exposure prophylactic medications (PrEP) (NIAID, “Pre-exposure Prophylaxis…” 2018) and prolonged successful use of ART give hope to some people; others lament the new challenges associated with aging as a PWH/PWA (Xxxxxx 2013). A 2014 study establishes the lack of sexual transmission when PWH have undetectable viral loads (Cairns 2014). Alongside these medical advancements, government policies loosen some stigmatizing restrictions on HIV-positive individuals. In 2015, the FDA changes their lifetime ban on blood donations from gay, bisexual and other men who have sex with men (MSM) to a deferral of 12 months since last male-to-male sexual contact (American Red Cross 2019) and in the same year, a rule change allows for the recovery and transmission of HIV- positive organs for HIV-positive recipients within clinical research trials (Department of Health and Human Services 2015). As nominal HIV case reporting has been going on for a number of years, CDC has been able to monitor the trends in HIV diagnoses and outcomes, and report out on the status of the population. Stable trends in the data begin to emerge and, using routine surveillance data, CDC is able to focus prevention efforts more precisely, starting with Data to Care (D2C) programs, which link diagnosed individuals to social and medical care (CDC, “Data to Care” 2020), and later with molecular epidemiology.
