Technical Evaluation Report. The Agent shall have received, on or before the Closing Date, a report of the Independent Engineer, in form and substance satisfactory to the Agent and the Lenders, covering the technical and economic feasibility of the Project (including, but not limited to a review of engineering design, equipment selections, actual and projected performance, Construction Budget, Construction Schedule, actual and projected performance, adequacy of contingency, status of construction, relevant Project Documents, status of permits and licenses and compliance with applicable zoning laws) and covering such other matters as the Agent may reasonably request.
