That the LICENSEE is a Web TV enterprise, namely an enterprise providing television services via the Internet, which presents its program to the public through a non- interactive, unaltered continuous stream (live streaming) and also makes its program accessible to the public, in whole or in part, in such a way that anybody may access it whenever and wherever they wish to (webcasting on demand) and That the LICENSEE’s program, which is presented to the public via the Internet under the above makes use of musical works, whose intellectual property rights management has been assigned to ORFIUM (hereinafter referred to as the “WORKS”) and that the LICENSEE wishes to obtain a license to use the WORKS for this purpose and the following were agreed and mutually accepted:
