Common use of Tangible Property Clause in Contracts

Tangible Property. The facilities, machinery, ----------------- equipment, furniture, buildings and other improvements, fixtures, vehicles, structures, any related capitalized items and other tangible property material to the business of the Company or any of the Subsidiaries (the "Tangible Property") are in good operating condition and repair, subject to continued repair and replacement in accordance with past practice, and are suitable for their intended use. During the past three years there has not been any significant interruption of the operations of the Company or any of the Subsidiaries due to inadequate maintenance of the Tangible Property.

Tangible Property. The facilities, machinery, ----------------- equipment, furniture, buildings and other improvements, fixtures, vehicles, structures, any related capitalized items and other tangible property material to the business of the Company or any of the Subsidiaries (collectively, the "Tangible Property") are in good all material respects in adequate operating condition and repaircondition, subject to continued repair and replacement in accordance with past practice, and are suitable for their intended useuse in accordance with past practice. During the past three years years, there has not been any significant material interruption of the operations of the Company or any of the Subsidiaries due to inadequate maintenance of the Tangible Property.

During the past three years there has not been any significant interruption of the operations of the Company or any business of the Subsidiaries Company due to inadequate maintenance of the Tangible PropertyProperty or otherwise.

During the past three years there has not been any significant interruption of the operations of the Company or any of the Subsidiaries its subsidiaries due to inadequate maintenance of the Tangible Property.
