System Qualifications Clause Samples

The System Qualifications clause defines the minimum technical or operational standards that a system must meet to be accepted under the contract. System Qualifications. All Biomass/Biogas CHP (Thermal) Customer Systems must meet the following system and installation requirements to qualify for Tucson Electric Power Company’s (“TEP” or the “Company”) Renewable Energy Credit Purchase Program. Capitalized terms not defined herein shall have the meanings ascribed to them in the Renewable Energy Credit Purchase Program Agreement.
System Qualifications. The second sentence of Section 1 is hereby deleted in its entirety and replaced by the following: “Affiliate represents and warrants that all Systems are at least [***] percent ([***]%) owned by or are managed by Affiliate or an entity controlling, controlled by, or under common control with Affiliate.”
