Survival of Confidentiality Restrictions. The covenants of confidentiality set forth in this Section 16 will (i) apply after the Effective Date to all Protected Information disclosed to the receiving Party before and after the Effective Date, and (ii) continue and must be maintained from the Effective Date through the termination of the Agreement and (a) with respect to Trade Secrets, at any and all times after the termination of the Agreement during which such Trade Secrets retains their status as a "trade secret" under applicable law; and (b) with respect to Confidential Information, for the shorter of a period equal to three (3) years after termination of the Agreement, or until such Confidential Information no longer qualifies as confidential under applicable law.
