Common use of Survival and Severance Clause in Contracts

Survival and Severance. The provisions of this SECTION 18 are intended to be severable from the other provisions of this Agreement and to survive and not be merged into any Termination of this Agreement or any judgment entered in connection with any dispute, regardless of whether such dispute arises before or after Termination of the Agreement, and regardless of whether the related arbitration or litigation proceedings occur before or after Termination of this Agreement. If any part of this SECTION 18 is held to be unenforceable, it shall be severed and shall not affect either the duty to mediate or arbitrate or any other part of this SECTION 18.
