Surrounding Area. The areas adjacent to a public street shall be maintained with suitable landscaping of plants, shrubs, trees, grass, and similar landscaping materials. The landscaping plan shall be approved by the city as to type, size and amount of landscaping.
Surrounding Area. Purchaser hereby acknowledges that Seller has made no representations and has no obligation to Purchaser with respect to (i) designs of other Condominiums Units, (ii) location, position, and visibility of utility lines, pipes, poles, boxes or other similar equipment, or (iii) use or prospective use of any property outside the building in which the Unit is located, notwithstanding any plats, site plans or other illustrative material.
Surrounding Area. Because Meritage may not have any control over the area surrounding or adjacent to the Lot, Meritage strongly recommends that Buyer drive and walk around or otherwise inspect the Community and the surrounding area (and conduct any other desired research) in order to become familiar with local conditions such as traffic, noise, prospective future development, and other factors prior to consummating the purchase transaction. Across the street on the west side of University Avenue East is a residential subdivision with predominantly single detached dwellings backing on to University Avenue East and the Parkwood Seniors’ Community. Beyond the Xxxxxx Xxxx Trail to the north is the Xxxx Xxxxxx Farmstead, RIM Park Manulife Sportsplex and Grey Silo Golf Course. In terms of amenities, there is the RIM Park Manulife Sportsplex and Grey Silo Golf Course. The Subject Land is currently underserviced by commercial developments. This part of University Avenue East is regularly serviced by GRT via the University iXpress 202 bus.

  • Boundaries All of the improvements which were included in determining the appraised value of the Property lie wholly within the boundaries and building restriction lines of the Property, and no improvements on adjoining properties encroach upon the Property, and no easements or other encumbrances upon the Property encroach upon any of the Improvements, so as to affect the value or marketability of the Property except those which are insured against by the Title Insurance Policy.

  • Parking Areas Landlord and Tenant agree that Landlord will not be responsible for any loss, theft or damage to vehicles, or the contents thereof, parked or left in the parking areas of the Premises and Tenant shall install at least one sign in the parking areas so advising its employees, visitors or invitees who may use such parking areas. Except as otherwise provided in this Section 3.5, parking areas shall be used for parking by vehicles no larger than full-size passenger automobiles or pick-up trucks, herein called "Permitted Size Vehicles." Vehicles other than Permitted Size Vehicles shall be parked and loaded or unloaded as directed by Landlord in the Rules and Regulations. Tenant shall not permit or allow any vehicles that belong to or are controlled by Tenant or Tenant's employees, suppliers, shippers, customers, contractors or invitees to be loaded, unloaded or parked in areas other than those designated by Landlord for such activities. Tenant agrees not to use or permit its employees, visitors or invitees to use the parking areas for overnight storage of vehicles, except for trucks on the Premises in the process of loading or unloading, and except for semi-tractors and trailers parked in the areas shown on the Site Plan as "Tenant's Designated Truck Parking". Tenant covenants and agrees that it shall not permit any of its employees, agents, contractors, vendors or shippers to park trucks, automobiles, trailers or other vehicles on any of the public streets in the general vicinity of the Premises or the industrial or business park in which the Premises are located. If Tenant permits or allows any of the prohibited activities described above for a period of five (5) business days after written notice from Landlord, then Landlord shall have the right, without further notice, in addition to such other rights and remedies that it may have, to remove or tow away the vehicle involved at Landlord's risk and expense. All responsibility for damage and theft to vehicles and their contents is assumed by the parties owning the same, including, respectively, Tenant or Tenant's partners, trustees, officers, directors, shareholders, members, invitees, or any of Tenant's assignees, subtenants or assignees' or subtenants' agents, employees, contractors, customers, suppliers, servants, guests, or independent contractors (collectively, "Tenant Parties").
