Suite 200. Licensor shall maintain the executive lounge currently designated “Suite 200” (or a private hospitality area of substantially similar size offering substantially similar amenities, in the same or a different location in the Arena) for the use of senior executives and their invited guests (“Suite 200”). The Knicks shall have access to Suite 200 during Home Games in a manner consistent with past practice and shall bear or reimburse Licensor for all out-of-pocket costs associated with operating Suite 200 for Home Games. Any annual increase to the aggregate costs charged to the Knicks for operating Suite 200 shall not exceed [*****]% without the Knicks prior written approval, not to be unreasonably withheld, conditioned or delayed. The Knicks agree that senior executives of Licensor and their invited guests shall have complimentary access to Suite 200 during Home Games on the same basis as senior executives of the Knicks and their invited guests.

The Rangers shall have access to Suite 200 during Home Games in a manner consistent with past practice and shall bear or reimburse Licensor for all out-of-pocket costs associated with operating Suite 200 for Home Games. Any annual increase to the aggregate costs charged to the Rangers for operating Suite 200 shall not exceed [*****]% without the Rangers prior written approval, not to be unreasonably withheld, conditioned or delayed. The Rangers agree that senior executives of Licensor and their invited guests shall have complimentary access to Suite 200 during Home Games on the same basis as senior executives of the Rangers and their invited guests.
Suite 200. In the event EverHome terminates its lease with HBE prior to the date that OMB delivers possession to Overstock, Overstock shall have the option to lease Suite 200 from HBE on the terms and conditions specified in this paragraph 4. Overstock shall give HBE written notice that it desires to lease Suite 200 within ten (10) business days after HBE notifies Overstock that HBE has agreed to an early termination of EverHome’s lease of Suite 200. In the event Overstock exercises its option to lease Suite 200, the term of the lease shall commence on the date that the lease between HBE and EverHome terminates and shall terminate on the Commencement Date (as defined in paragraph 2 above) (the “Suite 200 Lease Term”). Overstock shall pay HBE Base Rent in the amount of the “Suite 200 Base Rent” set forth on Exhibit A, payable monthly during the Suite 200 Lease Term. In the event the Suite 200 Lease Term commences on a day other than the first day of a month or ends on a day other than the last day of a month, the rent for the first and last months shall be pro rated on the basis of a 30 day month. Overstock shall be responsible for Operating Expenses with respect to Suite 200 during the Suite 200 Lease Term, including its pro rata share of any adjustment after termination of the Suite 200 Lease Term. Except as specifically provided in this paragraph 4, all of the terms and conditions of the Suite 100 Lease shall apply to Suite 200 during the Suite 200 Lease Term.
Suite 200. As of the Suite 200 Commencement Date (as defined in paragraph 2 below), Section 1 of the Lease shall be amended to include approximately 9,959 rentable square feet identified as Suite 200 in Building 3 (the "Suite 200 Expansion Space") and described in more detail in Exhibit A, attached hereto. As of the Suite 200 Commencement Date, the term "Premises" shall mean all of the Original Premises and the Suite 200 Expansion Space. Landlord and Tenant hereby agree that as of the Suite 200 Commencement Date, the rentable square footage of the Premises shall be increased by 9,959 rentable square feet.
Suite 200. The "Suite 200 Commencement Date" shall be that date which is thirty (30) days after the date upon which the prior lease for the Suite 200 Expansion Space terminates (the "Suite 200 Prior Lease Termination Date"). Landlord estimates that the Suite 200 Prior Lease Termination Date will be November 30, 1999 and accordingly estimates that the Suite 200 Commencement Date will be January 1, 2000. In the event that the Suite 200 Prior Lease Termination Date does not occur by January 31, 2000, (1) Tenant shall have the right, but not the obligation, to terminate its obligation to lease the Suite 200 Expansion Space from Landlord by delivering written notice of such decision to Landlord so long as such notice is delivered to Landlord prior to Landlord's delivery to Tenant of written notice specifying the Suite 200 Prior Lease Termination Date, and (2) Landlord shall have the right, but not the obligation, to terminate its obligation to lease the Suite 200 Expansion Space to Tenant by delivering written notice of such decision to Tenant so long as Landlord has not previously delivered written notice to Tenant
Suite 200. As of the Suite 200 Commencement Date, the Tenant's Proportionate Share of Building 3 for the Suite 200 Expansion Space shall be increased by 14.22%.
Suite 200. Included in the Base Rent payable for the Suite 200 Expansion Space, Landlord shall provide up to $39,836.00 (i.e., $4.00 per square foot of the Suite 200 Expansion Space) (the "Suite 200 First Level Tenant Improvement Allowance"). The entire Suite 200 First Level Tenant Improvement Allowance must be used for the Expansion Spaces Tenant Improvement Costs for the Suite 200 Expansion Space. Any portion of the Suite 200 First Level Improvement Allowance which is not requested by Tenant within six (6) months of the Suite 200 Commencement Date shall be forfeited (i.e., the unused shall not be applied against rent or other obligations of Tenant under the Lease).
Suite 200. A second level Expansion Spaces Tenant Improvement Allowance (the "Suite 200 Second Level Tenant Improvement Allowance") of up to $9,959.00 (i.e., $1.00 per square foot of the Premises) shall also be made available to Tenant for the Expansion Spaces Tenant Improvement Costs for the Suite 200 Expansion Space; provided that for each dollar ($1.00) of the Suite 200 Second Level Tenant Improvement Allowance disbursed by Landlord, the monthly Base Rent payable hereunder for the Suite 200 Expansion Space would be increased by $0.032 per square foot per month. Thus, if all of the Suite 200 Second Level Tenant Improvement Allowance is used, the initial monthly Base Rent payable hereunder for the Suite 200 Expansion Space would be increased by $318.68 per month (i.e., $9,959.00 x 0.032/sq.ft.). In the event any portion of the Suite 200 Second Level Tenant Improvement Allowance is used, Landlord and Tenant agree to execute an amendment to the Lease to increase the amount of Base Rent payable hereunder for the Suite 200 Expansion Space in the manner described above (i.e., retroactively to the Suite 200 Commencement Date) and at such time Tenant shall be required to pay to Landlord in a single cash lump sum all Base Rent increases for the Suite 200 Expansion Space for those months which preceded the date of such amendment. Any portion of the Suite 200 Second Level Tenant Improvement Allowance which is not requested by Tenant within six (6) months of the Suite 200 Commencement Date shall be forfeited (i.e., the unused shall not be applied against rent or other obligations of Tenant under the Lease).
Suite 200. The parties have agreed to amend the Lease with respect to Suite 200 as follows:
