Common use of Successor Facility Agent Clause in Contracts

Successor Facility Agent. If the Facility Agent gives notice of its resignation pursuant to Clause 29.9 (Resignation) or it is removed pursuant to Clause 29.10 (Removal of Facility Agent), then any reputable and experienced bank or other financial institution which is a Bank may after consultation with the Borrower be appointed as a successor to the Facility Agent by the Instructing Group during the period of such notice but, if no such successor is so appointed, the Facility Agent may appoint such a successor itself (which successor must be a Bank).
