Substitute Storage Facilities Sample Clauses
The Substitute Storage Facilities clause allows a party to use alternative storage locations in place of the originally designated facilities. In practice, this means that if the primary storage site becomes unavailable or unsuitable, the party responsible for storage can select and utilize another facility that meets agreed-upon standards or requirements. This clause ensures continuity of storage services and mitigates risks associated with disruptions at the original site, thereby providing flexibility and safeguarding the interests of both parties.
Substitute Storage Facilities. If at any time during the term of the Agreement, the Operator finds it necessary to provide substitute storage facilities to the Customer, the Operator may do so provided any additional costs involved in the transfer of Products is at the expense of the Operator and the Operator has obtained the Customer’s prior approval (not to be unreasonably withheld or delayed). Any such substitute storage facilities, while in use under this Agreement, shall be Storage Facilities referred to in this Agreement. The Operator shall compensate the Customer for the cost of any Product lost as a result of the use of such substitute Storage Facilities which is only beyond the tolerance rule of 0.5 % plus or minus and that is caused by gross negligence of the Operator.
