Subsequent Modifications. No amendment, alteration or modification of the Agreement shall be effective or binding unless it is set forth in a writing signed by duly authorized representatives of both parties.

Any written agreement or agreements hereafter entered into by the Mortgagee which (i) extend the time of payment of the Indebtedness, (ii) change or modify the time or times of payment or the amount of the installments or fixed sums or the interest or the rate thereof, (iii) change, modify, extend, renew or terminate other terms, provisions, covenants or conditions of the Consolidated Mortgage or the obligations which it secures or this Agreement, or (iv) consolidate, spread, release or sever the lien of the Consolidated Mortgage shall be effective in accordance with the terms and provisions thereof and shall be binding according to the tenor thereof on the owner or holder of subordinate, intervening or subsequent liens or security interests on the Premises and any such liens or security interests shall continue to be subject and subordinate to this Consolidated Mortgage and any such agreement or agreements.
Subsequent Modifications. Modifications, changes, delayed shipments, cancellations and additions to a Purchase Order will be valid subject to Vestshell's written consent and in accordance with conditions designed to compensate Vestshell for any losses, including, but not limited to, parts completed at unit price, in-process parts at unit price adjusted for progress, raw materials that have been specially ordered for said order, overhead, storage costs and tooling.

The Lender may or may not, in the Lender's sole discretion, agree with the Borrower from time to time to modify, extend or otherwise change the payment dates, amounts, interest rate or other provisions of the Note or the other Obligations, but if so, no such change, extension or modification shall affect in any way the Lien or priority of the security interest granted under this Agreement.

The assignment of this Lease by the Tenant with the consent of the Owner shall, without being specifically so stated or agreed, constitute the express agreement by the Tenant that subsequent modifications of this Lease by the Owner and the assignee shall not (i) require the prior consent or approval of the Tenant (assignor), or (ii) release or relieve the Tenant (assignor) from liability hereunder, provided that if such modifications increase the rent or other obligations of the Tenant hereunder, the Tenant's (assignor's) liability shall be limited to the terms of this Lease as the same existed on the date of assignment.
