Subsequent Development Review Sample Clauses
Subsequent Development Review. The City shall not require Developer to obtain any approvals or permits for the development of the Project in accordance with this Agreement other than those permits or approvals which are required by the Reserved Powers and/or the Project Approvals. Any subsequent Discretionary Action initiated by Developer which substantially changes the entitlements allowed under the Project Approvals, shall be subject to rules, regulations, ordinances and official policies of the City then in effect. A substantial change to the entitlements allowed under the Project Approvals that would require subsequent Discretionary Action(s) include: (a) a net increase in the amount of Project square footage, building heights and/or expansion of building footprints, and/or (b) a reduction in the number of automobile parking spaces identified in the Project Approvals (collectively referred to as “Substantial Project Changes”). The parties agree that this Agreement does not modify, alter or change the City’s obligations pursuant to CEQA and acknowledge that future Discretionary Actions may require additional environmental review pursuant to CEQA. In the event that additional environmental review is required by CEQA, the City agrees to utilize tiered environmental documents to the fullest extent permitted by law, as determined by the City, and as provided in California Public Resources Code Sections 21093 and 21094.

However, any subsequent Discretionary Action initiated by Developer, which substantially changes the permitted uses or substantially increases the height, density or floor area allowed under the Project Approvals, shall be subject to the rules, regulations, ordinances and official policies of the City then in effect; provided, however, that no such subsequent Discretionary Action, when approved, will constitute grounds for the termination of this Agreement or otherwise affect the enforceability of this Agreement with respect to the development of the Property hereunder. The Parties agree that this Agreement does not modify, alter or change the City’s obligations pursuant to CEQA and acknowledge that future Discretionary Actions may require additional environmental review pursuant to CEQA. The parties agree that this Agreement does not modify, alter or change the City’s obligations pursuant to CEQA and acknowledge that future Discretionary Actions may require additional environmental review pursuant to CEQA.
Subsequent Development Review. The City shall not require Disney to obtain any approvals or permits for the development of the Project in accordance with this Agreement other than those permits or approvals which are required by the Applicable Rules or the Reserved Powers. However, any subsequent Discretionary Action initiated by Disney which changes the uses, intensity, density, or building height of the Project, or decreases the lot area, setbacks, yards or parking or other entitlements permitted on the Disney Property pursuant to the DRSP and the ARSP or otherwise modifies the DRSP and the ARSP shall be subject to the rules, regulations, ordinances and officially adopted plans and policies of the City then in effect.
Subsequent Development Review. Nothing set forth herein shall impair or interfere with the right of City to require the processing of building permits as required by law pursuant to the applicable provisions of the La Quinta Municipal Code and the provisions of Uniform Codes. Prior to each request for a building permit, Developer shall provide City with a Compliance Certificate (“Certificate”) in a form created by Developer and approved by City, which shall describe how all applicable Conditions of Approval have been fully complied with. Each Certificate shall be distributed by City to the relevant City departments for checking the representations made by Developer on the Certificate.
Subsequent Development Review a. Following the approval of a Coordinated Development Special Permit, applicants may proceed with the development review required for individual lots.
