Subject to E Sample Clauses

The "Subject to E" clause establishes that the provisions or obligations outlined are conditional upon or subordinate to the terms set forth in section E of the agreement. In practice, this means that if there is any conflict or overlap between the current section and section E, the terms of section E will take precedence. This clause ensures that the agreement remains internally consistent and that section E governs in cases of ambiguity or contradiction, thereby preventing disputes over which terms apply.
Subject to E. 25.5 (a), where a letter of reprimand is placed in a teacher's file, the teacher may request to have the letter(s) removed five (5) years after filing. The letter will be removed provided that no further letters of reprimand have been subsequently filed. Letters of reprimand for incidents of a minor nature may be removed two (2) years from the date of filing if so requested by the teacher, provided that no further letters of reprimand have been subsequently filed.
Subject to E. 03 and E.04 above, the choice of annual vacation periods shall be governed by seniority within the Maintenance I level classification and the Maintenance II level classification unless mutually agreed on between the Employees of each classification.
Subject to E. 2.1 and unless agreed otherwise between the employer and employee, an employee may commence parental leave at any time within 6 weeks immediately prior to the expected date of the birth.
