Subjacent Support Sample Clauses
Subjacent Support. The right to mine by approved mining method all of the mineable and merchantable coal within and underlying the demised premises without leaving any subjacent support for the overlying strata and without being liable for any damages which may be caused by the removal of all of such coal to the overlying or underlying strata therein or thereon or to any objects or structures thereon; provided, however, that where Lessor does not own any portion of the demised premises in fee simple, Lessor's waiver of subjacent support on that portion of the surface is conditional upon Lessee obtaining a like waiver from persons owning any outstanding surface interest or other interests and situate within the demised premises.
Subjacent Support. Article (14) is amended by adding the following immediately after the first sentence: “To the extent it has the right to do so, Lessor hereby waives the right to lateral and subjacent support and any claim or liability for damages to the surface or subsurface or water thereon or therein, CONFIDENTIAL MATERIAL HAS BEEN OMITTED AND FILED SEPARATELY WITH THE SECURITIES AND EXCHANGE COMMISSION. BOXES AND ASTERISKS DENOTE SUCH OMISSION. and grants Lessee the right to subside the overlying strata, including water, without liability to Lessor therefor.”
