Subcontractor Delegation. Any subcontract entered into by the Contractor shall fulfill the requirements of 42 CFR Parts 434 and 438 that are appropriate to the service or activity delegated under such subcontract. The contractor shall monitor any functions and responsibilities it delegates to any subcontractor. The Contractor must require each physician to have a unique national provider identifier (NPI). The contractor shall be accountable for any and all functions and responsibilities it delegates to a subcontractor. The contractor shall obtain the prior approval of DMAHS for any such delegation and shall meet the requirements of 42 C.F.R. § 438.230.
