Sub-Subcontractors Sample Clauses
The Sub-Subcontractors clause defines the rules and requirements for a subcontractor to further subcontract portions of their work to other parties, known as sub-subcontractors. Typically, this clause requires the subcontractor to obtain prior written approval from the main contractor before engaging any sub-subcontractors, and may impose conditions such as ensuring that sub-subcontractors are bound by the same obligations as the original subcontractor. Its core function is to maintain control and oversight over the quality and reliability of work performed on the project, reducing the risk of unauthorized or unsuitable parties being involved.
Sub-Subcontractors. 15% of the Allowable Costs of that portion of the Work to be performed by Sub- subcontractors of the second and lower Tier with their own forces, plus 2.5% thereon for the Subcontractor, plus 2.5% on the combined total thereof for Contractor Markup.
Sub-Subcontractors. 1.10.1. The requirements under this Attachment shall apply to Subcontractor’s subcontractors, to the lowest tier and in all respects. Subcontractor shall require by written agreement that all tiers of its subcontractors comply with this Attachment and carry all insurance required hereunder in like form and amounts, including any and all additional insured and other requirements. It is Subcontractor’s sole responsibility to require all tiers of its sub- subcontractors to provide insurance that meets the same requirements as Subcontractor in this attachment and monitor compliance.
1.10.2. Upon request from Contractor, Subcontractor shall obtain and submit to Contractor, in a timely manner to allow for sufficient review and follow up if and as necessary, certificates of insurance that demonstrate the proper insurance coverages and amounts (in conformance with this Attachment) from each and every subcontractor of Subcontractor, to the lowest tier, before any work whatsoever by any of Subcontractor’s subcontractors may commence on the jobsite.
Sub-Subcontractors. 2.6.1 Design-Build Subcontractor shall employ only Sub-Subcontractors who are reasonably satisfactory to Design-Builder and who are duly licensed and qualified to perform the Work
Sub-Subcontractors. Subcontractor shall be responsible in full for any and all acts and omissions of its own subcontractors, employees, suppliers, and all others performing any work on this Project under the auspices of Subcontractor.

2.6.2 Design-Build Subcontractor assumes responsibility to Design-Builder for the proper performance of the Work of Sub-Subcontractors and any acts and omissions in connection with such performance. Design-Build Subcontractor shall coordinate the activities of all Sub-Subcontractors. Nothing in this Agreement is intended or deemed to relieve Design-Build Subcontractor from responsibility for the work performed by its Sub-Subcontractors, or create any legal or contractual relationship between Owner or Design-Builder and any Sub-Subcontractor, including but not limited to any third-party beneficiary rights.
Sub-Subcontractors. The Contractor shall require each Subcontractor to enter into similar agreements with its Subcontractors which complies with the requirements of Paragraphs 5.2.1 and 5.2.2 hereinabove.
Sub-Subcontractors. No work may be subcontracted without the prior written approval of Builder, which reserves the right to disapprove any proposed sub-subcontractor whose record does not establish, in Builder’s sole judgment, the experience, competence and financial ability of the sub-subcontractor to perform the applicable portion of Subcontractor’s work. Notwithstanding Builder’s approval of any sub-subcontractor, Subcontractor shall remain fully liable to Builder for performance of its work, including the portions subcontracted. Nothing contained in this Agreement shall create any contractual relationship between any sub-subcontractor or supplier and Builder, or create any obligation on the part of Builder to make payment of any sums to any sub-subcontractor or supplier, or any other party not directly contracting with Builder.
Sub-Subcontractors. 2.6.1 Design-Build Subcontractor shall employ only Sub-Subcontractors who are reasonably satisfactory to Design-Builder and who are duly licensed and qualified to perform the Work consistent with the Contract Documents. Design-Build Subcontractor agrees that each Sub-Subcontractor shall be fully bound to Design-Build Subcontractor in the same manner as Design-Build Subcontractor is bound to Design-Builder for all the requirements of the Contract Documents to the extent applicable to the Sub-Subcontractor’s scope of work.
2.6.2 Design-Build Subcontractor assumes responsibility to Design-Builder for the proper performance of the Work of Sub-Subcontractors and any acts and omissions in connection with such performance. Design-Build Subcontractor shall coordinate the activities of all Sub-Subcontractors. Nothing in this Agreement is intended or deemed to relieve Design-Build Subcontractor from responsibility for the work performed by its Sub-Subcontractors, or create any legal or contractual relationship between Owner or Design-Builder and any Sub-Subcontractor, including but not limited to any third-party beneficiary rights.
Sub-Subcontractors. 3.1 The Subcontractor shall not assign or subcontract this Agreement, any of the Work or any portion thereof without prior written consent of ▇▇▇▇▇▇ ▇▇▇▇▇. ▇▇▇▇▇▇ ▇▇▇▇▇'▇ consent to assignment or sub-subcontracting of any portion of the Work shall not relieve the Subcontractor of its responsibilities under this Agreement or create any privity of contract between ▇▇▇▇▇▇ ▇▇▇▇▇ and any Sub-Subcontractor performing such assigned Work, except for ▇▇▇▇▇▇ ▇▇▇▇▇'▇ right to enforce certain provisions of this Agreement against a Sub-Subcontractor as set forth herein. If applicable, Appendix G - List of Approved Sub-Subcontractors sets out the list of Sub-Subcontractors ▇▇▇▇▇▇ ▇▇▇▇▇ has approved, and any changes thereto shall be subject to ▇▇▇▇▇▇ ▇▇▇▇▇'▇ approval using the Change Order process in Section 6.
3.2 The Subcontractor shall bind each of its Sub-Subcontractors to the provisions of the Agreement to the extent that the Subcontractor is bound to ▇▇▇▇▇▇ ▇▇▇▇▇.
3.3 The Subcontractor shall at all times be responsible for the performance or non-performance of all Sub-Subcontractors and shall coordinate all Sub-Subcontractor activities to ensure compliance of the Subcontractor's obligations with the Agreement.
.1 The Subcontractor shall not permit any Lien to exist or be filed or registered by any Sub-Subcontractor in respect of the Work. If a Lien is filed by any Sub-Subcontractor, the Subcontractor shall, at its cost, immediately take the steps set forth in Appendix I - Lien Discharge Process to discharge such Lien, failing which ▇▇▇▇▇▇ ▇▇▇▇▇ may, on giving the Subcontractor Notice, take such steps and set off any and all costs incurred in respect thereto against the Subcontractor. Any and all amounts paid by ▇▇▇▇▇▇ ▇▇▇▇▇ to release, vacate or discharge any Lien filed by a Sub-Subcontractor or otherwise through the Subcontractor, including legal costs on a solicitor-client basis, shall be a debt owed by the Subcontractor to ▇▇▇▇▇▇ ▇▇▇▇▇ and may be set-off by ▇▇▇▇▇▇ ▇▇▇▇▇ against any amounts owed to the Subcontractor.
.2 If the Subcontractor files a Lien on the Project then, upon ▇▇▇▇▇▇ ▇▇▇▇▇ performing the applicable steps set out in Appendix I - Lien Discharge Process, the Subcontractor shall be deemed to have agreed to discharge its Lien.
3.5 When requested by ▇▇▇▇▇▇ ▇▇▇▇▇, the Subcontractor shall furnish ▇▇▇▇▇▇ ▇▇▇▇▇ with a statutory declaration prepared by any Sub-Subcontractor setting out such statements as ▇▇▇▇▇▇ ▇▇▇▇▇ may reasonably require, including but ...
Sub-Subcontractors. The Subcontractor shall preserve and protect the rights of the parties under the Subcontract with respect to Subcontract Work to be performed under sub-subcontract, and shall: .1 enter into contracts or written agreements with Sub-Subcontractors to require them to perform their work as provided in the Subcontract Documents;
