SUB-CONSULTANT/CONTRACTOR Clause Samples

SUB-CONSULTANT/CONTRACTOR. (a) If circumstances arise which require expertise outside the field of practice of the Consultant/Contractor, the Consultant/Contractor may, with the prior written approval of the Principal, engage an appropriate sub-Consultant/Contractor to perform relevant Services under this Agreement. The Consultant/Contractor shall be responsible for the engagement of and payment for any Services provided by sub-Consultant/Contractors, and shall accept responsibility for those Services. (b) The Consultant/Contractor must ensure that it is a term of any agreement to subcontract that the remuneration and terms of employment of any employee employed by a sub- Consultant/Contractor for the performance of the agreement to subcontract will, for the duration of the agreement to subcontract, be consistent with the remuneration and terms of employment that reflect the industry standard as expressed in awards and agreements and any code of practice that may apply to a particular industry. (c) The Consultant/Contractor must, if requested by the Principal, supply to the Principal a copy of any subcontract, which copy may exclude commercially sensitive information but must indicate that the Consultant/Contractor has complied with this clause 20. (d) The engagement by the Consultant/Contractor of a sub-Consultant/Contractor does not relieve the Consultant/Contractor from its obligation to perform the Consultant/Contractor's obligations under this Agreement.
