Strategic analysis. Vancouver and Burnaby have had a good working relationship under the past agreements for maintaining Boundary Road. A new Boundary Road Maintenance Agreement has been drafted based on previous agreements with only minor updates and clarifications being proposed as described below. A copy of the new agreement, including the minor modifications from the previous agreement is attached as Appendix A. In 2013, the City of Burnaby completed modifications to the Canada Way and Schou intersection along Boundary Road. Schedule D of the agreement has been updated from its 2008 version to reflect the new intersection configuration. In addition, Clause 6 of the agreement was updated to clarify that any billing for maintenance costs should be itemized by the categories of work outlined in the agreement. The City of Burnaby approved the new form of Boundary Road Maintenance Agreement at their July 21, 2014, Council meeting. Section 246(2) of the Local Government Act, which applies to Vancouver, pursuant to section 246(3(b)) of the Local Government Act, requires that a by-law be adopted by each respective Council to make valid an agreement between two municipalities. This requirement is necessary when two municipalities have joined together to exercise a power that extends beyond the boundaries of their respective municipality. During the maintenance of portions of Boundary Road, Vancouver will be working on land within the municipality of Burnaby. Implications/Related Issues/Risk (if applicable) Financial There are no financial implications. The new Boundary Road maintenance agreement is consistent with previous agreements and does not change the maintenance responsibilities currently being completed by the City.
