Storage Capacity Test. A.1 General
Storage Capacity Test. Prior to the Commercial Operation Date, Seller will schedule and complete one or more Storage Capacity Tests in accordance with the testing requirements of the BSA.3 Thereafter, at least once per Contract Year, Seller will schedule and complete a Storage Capacity Test in accordance with such testing requirements. Both Parties will have the right to run one or more retests (not more often than monthly) of the Storage Capacity Test in accordance with such testing requirements. If the actual capacity of the Storage Facility determined pursuant to a Storage Capacity Test is less than the then current Storage Capacity Rating, then the actual capacity determined pursuant to such Storage Capacity Test will become the new Storage Capacity Rating at the beginning of the day following the completion of the test for all purposes under the BSA until a new Storage Capacity Rating is determined pursuant to a subsequent Storage Capacity Test, provided in no event will the Storage Capacity Rating be greater than the Storage Capacity Rating set forth in the Expected Storage Requirements.
Storage Capacity Test. A.1 General The Storage Capacity Test (“Storage Capacity Test” or “SCT”) is a test performed to determine the then-current Storage Capacity and Round-Trip Efficiency (RTE). Each Storage Capacity Test (including the initial Storage Capacity Test performed prior to Commercial Operation and each subsequent Storage Capacity Test) shall be conducted in accordance with Prudent Utility Practices and the provisions of this Exhibit O. Buyer or its representative may be present for any SCT and may, for informational purposes only, use its own metering equipment (at Buyer’s sole cost).
Storage Capacity Test. Prior to the first Deliverability Notice, Seller shall complete an energy storage capacity test for Storage Facilities in accordance with procedures, requirements, and protocols dictated by the independent engineer that will be engaged as part of the project financing process. Seller shall provide Purchaser three days’ notice of such test. Purchaser shall have the right to send one or more representative(s) to witness all Storage Capacity Tests. Purchaser shall be responsible for all costs, expenses, and fees payable or reimbursable to its representative(s) witnessing any Storage Capacity Test. All other costs of any Storage Capacity Test shall be borne by Seller. Following each Storage Capacity Test, Seller shall provide a copy of the results of the energy storage capacity test, as verified by the independent engineer. If the actual capacity determined pursuant to a Storage Capacity Test is less than the current Contract Capacity of the Storage Facilities, then the actual capacity determined pursuant to a Storage Capacity Test shall become the new Contract Capacity of the Storage Facilities at the beginning of the day following the completion of the test for all purposes under this Agreement.

Developer shall implement under-frequency and over-frequency relay set points for the Large Generating Facility as required by the NPCC to ensure “ride through” capability of the New York State Transmission System. Large Generating Facility response to frequency deviations of predetermined magnitudes, both under-frequency and over-frequency deviations, shall be studied and coordinated with the NYISO and Connecting Transmission Owner in accordance with Good Utility Practice. The term “ride through” as used herein shall mean the ability of a Generating Facility to stay connected to and synchronized with the New York State Transmission System during system disturbances within a range of under-frequency and over-frequency conditions, in accordance with Good Utility Practice and with NPCC Regional Reliability Reference Directory # 12, or its successor.

  • SLEEPING CAPACITY/DISTURBANCES Tenant and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: Occupancy exceeding the sleeping capacity, using the premises for any illegal activity, causing damage to the premises rented or to any of the neighboring properties and any other acts which interfere with neighbors' right to quiet enjoyment of their premises. iTrip or the Owner, does not assume any liability for loss, damage or injury to persons or their personal property. Neither does the owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, electricity or plumbing, as well as due to weather conditions, natural disasters, acts of God, or other reasons beyond its control. Tenant hereby acknowledges that the premises they have reserved may include a pool and the undersigned agrees and acknowledges that the pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the community pool and patio areas.
