Common use of Stayed Funds Clause in Contracts

Stayed Funds. If the Master Servicer is the subject of a proceeding under the federal Bankruptcy Code and the making of a remittance by the Master Servicer pursuant to this Agreement is prohibited by Section 362 of the federal Bankruptcy Code, funds which are in the custody of the Master Servicer, a trustee in bankruptcy or a federal bankruptcy court and should have been the subject of such remittance absent such prohibition. Subordinate Amount: On any date of determination, the excess of the aggregate Stated Principal Balance of the Mortgage Loans as of such date over the aggregate Class Certificate Balances of the Senior Certificates then outstanding. Subordinate Certificates: The Class M-1, Class M-2, Class M-3, Class M-IO, Class B-1, Class B-2 and Class B-3 Certificates. Subordinate Percentage: For any Distribution Date, the difference between 100% and the Senior Percentage for such date.
