Statutory Functions. 17.1 Nothing in this Agreement shall be construed as a ▇▇▇▇▇▇, restriction or oblige the Government, PCC or NPTCBC to do or omit to do anything which in each case: (a) is incompatible with the lawful exercise of its powers; or (b) is incompatible with the lawful discharge of its functions; or (c) divests it of its statutory powers; or (d) obliges it not to exercise its powers, and in every instance where there is an inconsistency or conflict between the Government, PCC and NPTCBC statutory functions (whether powers or duties) and the provisions of this Agreement, the Government, PCC and NPTCBC shall not be obliged to comply with the terms of this Agreement.
