SpilledProject Energy Sample Clauses

SpilledProject Energy. For the purposes of Section 3.1, there shall be deemed to have been sold and delivered an amount of Electric Energy equal to the amount of Electric Energy that could have been, but was not, generated by the Project as a result of the unwillingness or inability (including, without limitation, inability as a result of the New Project Transmission Facilities not being operational on the New Project Commencement Date) of the Utility to take such Electric Energy that was not generated.
