Specific Services-Related Commitments. The Operator commits to AHS that the Services as provided in the Facility will:
(a) comply in all respects with the requirements of this Agreement and good clinical practice;
(b) be performed by fully trained, qualified and accredited Staff (on an ongoing basis);
(c) be performed using equipment which is in good condition, which is suitable and adequate for the use being made and which has received such approvals and licenses as are required for proper operation in accordance with the requirements of all Applicable Laws, regulatory authorities and the manufacturer, where applicable; and
(d) be performed in a manner which reasonably ensures that all medical records related to Services performed at the Facilities will be transferred or transmitted accurately and expeditiously (by courier or electronic means, subject always to the form of transfer or transmittal used meeting the requirements of all Applicable Laws related to privacy and protection of data) to all those persons responsible for the ongoing care, if any, of Clients, in every case and AHS, when requested.

(a) comply in all respects with this Agreement;
(b) be performed by fully trained, qualified and Accredited personnel and staff (on an ongoing basis);
(c) be performed using Equipment which is in good condition, which is suitable and adequate for the use being made and which has received such approvals and licenses as are required for proper operation in accordance with the requirements of all regulatory authorities and, the manufacturer, where applicable; and
(d) be performed in a manner which reasonably ensures that all medical records related to Services performed at the Facilities will be transmitted accurately and expeditiously (by courier or electronic means) to all those persons responsible for the ongoing care, if any, of patients, in every case and the Region, when requested and in compliance with the HIA.

(a) be performed by fully trained, qualified and licensed (if applicable) accredited Staff (on an ongoing basis);
(b) be performed using Equipment which is in good condition, which is suitable and adequate for the use being made and which has received such approvals and licenses as are required for proper operation in accordance with the requirements of Schedule "C" of all Applicable Laws, regulatory authorities and the manufacturer, where applicable; and
(c) be performed in a manner which reasonably ensures that all Client records created by the Operator in the performance of the Services at the Facility will be transferred or transmitted accurately and expeditiously (by courier or electronic means, subject always to the form of transfer or transmittal used meeting the requirements of all Applicable Laws related to privacy and protection of data) to the RHA.

(a) comply in all respects with this Agreement;
(b) be performed by fully trained, qualified and accredited personnel and professional staff (on an ongoing basis) who have, without restriction, full registration with the College of Registered Nurses of Nova Scotia or such other professional registration or licensing body as may apply to such professionals ; as well as post-graduate nursing training in surgery or two years of operating room experience;
(c) be performed using equipment which is in excellent condition, which is suitable and adequate for the use being made and which has received such approvals and licenses as are required for proper operation in accordance with the requirements of all regulatory authorities and, the manufacturer, where applicable; and
(d) be performed in a manner which reasonably ensures that all medical records related to Services performed at the Facilities will be transmitted accurately and expeditiously (by courier or electronic means) to all those persons responsible for the ongoing care, if any, of patients, in every case and to Capital Health, when requested. Specifically, Capital Health will provide, by courier, to the Operator on a weekly basis those pre-operative records which are kept in relation to patients receiving Services for the upcoming week and the Operator will return those records and any records, notes or documents kept or prepared in the course of the provision of the Services to Capital Health, by Capital Health designated courier. The Operator will not retain copies of such records, however, Capital Health will, subject to the Operator obtaining specific consent as required under the Personal Information Protection and Electronic Documents Act, provide to the Operator those records in relation to the Surgery as are required by the Operator to maintain the required accreditation of the Facility.
