Common use of Specific Safeguards Clause in Contracts

Specific Safeguards. Notwithstanding other provisions of this Agreement, in particular Article 29 of this Agreement, given the particular sensitivity of the agricultural products, if imports of products originating in one Party, which are subject of concessions, granted under this Agreement, cause serious disturbances to the market of the other Party, the Party concerned shall enter into prompt consultations to find an appropriate solution. Pending such solution, the Party concerned may take appropriate measures it deems necessary.

Specific Safeguards. Notwithstanding other provisions of this AgreementAgreement and, in particular Article 29 of this Agreement20, and given the particular sensitivity of the agricultural products, if imports of products originating in one a Party, which are subject of concessions, to concessions granted under this Agreement, cause serious disturbances to the market markets of the other Party, the Party concerned shall immediately enter into prompt consultations within the Joint Committee with a view to find finding an appropriate and mutually acceptable solution. Pending such solution, the Party concerned may take appropriate measures it deems necessary, immediately notifying the other Party of the measures taken.

The type and duration of the measure should not go beyond what is strictly necessary to remedy the situation.
