Common use of SMUGGLING Clause in Contracts

SMUGGLING. 9.4.1 The Licensee shall take all necessary actions and precautions to prevent smuggling and to ensure that no goods other than Aggregates are brought in or permitted to be brought in by his barges or barges under his control. 9.4.2 In the event that smuggling occurs, the Licensee shall be liable to any charges brought by the Immigration and Checkpoints Authority, Singapore Customs or any other competent authority and the Licensee shall indemnify the Licensor against all expenses and costs (including legal costs on an indemnity basis) incurred by the Licensor as a result of the Licensee’s breach of this clause. 9.4.3 In the event that the Licensee needs to bring machinery, equipment and spare parts to his quarries overseas, the Licensee shall ensure that a written consent is obtained from the Maritime and Port Authority of Singapore (MPA) and a copy of the consent is sent to the Licensor.
