Site Data. (i) The Contractor shall be deemed to have inspected and examined the Site and its surroundings and to have satisfied himself before entering into the Agreement in all material respects including but not limited to:
Site Data. The Contractor shall be responsible for obtaining all necessary information as to risks, contingencies and other circumstances which may influence or affect the Contractor and its performance of Scope of Project. The Contractor is deemed to have inspected and examined the Site, its surroundings, and other available information, and to satisfy themselves about the Scope of Project under this Contract, including, without limitation:
Site Data. The Client shall cooperate with the Supplier and provide any site data ("Site Data") that is requested by the Supplier and that is in the Client's possession.
Site Data. Without prejudice to its obligations under Clause 13, the Contractor shall be responsible for any misunderstanding or incorrect information howsoever obtained, including any information provided by the Purchaser or the Engineer, except for the SON, the correctness & accuracy of which shall be the Purchaser's responsibility. Except for and subject to Clause 7.2, 27, 45 and 49, and the existence of hazardous materials or historical artefacts at the Site, no additional payment or adjustment to the Contract Price or extension of the Time for Completion shall be made on account of any conditions related to the Site, including without limitation underground conditions, hydrological, climatic, environmental or other physical conditions.
Site Data. In performing Services hereunder, Vendor shall compile data concerning each BTS Site and furnish such data to SBCW, all in accordance with the procedures set forth in Annex C and Annex G, including all Compliance Data and Completion Data.
Site Data. The Employer shall have made available to the Contractor for his information, prior to the Base Date, all relevant data in the Employer’s possession on sub- surface and hydrological conditions at the Site, including environmental aspects. The Employer shall similarly make available to the Contractor all such data which come into the Employer’s possession after the Base Date. The Contractor shall be responsible for interpreting all such data. To the extent which was practicable (taking account of cost and time), the Contractor shall be deemed to have obtained all necessary information as to risks, contingencies and other circumstances which may influence or affect the Tender or Works. To the same extent, the Contractor shall be deemed to have inspected and examined the Site, its surroundings, the above data and other available information, and to have been satisfied before submitting the Tender as to all relevant matters, including (without limitation):

Site Data. Upon EPA’s request, Respondent shall provide the requestor access to all records and documentation related to the conditions at the Site and to results or data pertaining to the restoration and mitigation activities conducted under this Consent Agreement.
Site Data. Buyer represents and warrants to Seller that it has furnished all Site Data to Seller as described in Exhibit D to Part A of the Agreement. Seller may assume that such Site Data furnished by Buyer are accurate, truthful and complete, and that they match the real conditions of the Site. Otherwise, Seller shall be entitled to an equitable adjustment in the Contract Price in order to cover the reasonable documented costs incurred in connection with adjustment of the Equipment to be suitable for the actual Site Data, the Programme and the Sale Warranties furnished pursuant to this Part A of the Agreement. With respect to the Wind Data Seller shall only be entitled to an equitable adjustment in the Contract Price in order to cover the reasonable documented costs incurred in connection with adjustment of the Equipment to be suitable for the actual Site Data, the Programme and the Warranties furnished pursuant to this Part A of the Agreement in the event that inaccuracies in these Wind Data require any modification in the supply which is the object of this Part A of the Agreement because the actual Wind Data conditions at the Site represent a different wind class than the IEC class IIA. In case of an adjustment in the Contract Price as set out in this Article, Article 7.4 second paragraph of this Part A of the Agreement shall apply. Both Parties agree that in case of an adjustment in the Contract Price an amendment to this Agreement has to be signed by both Parties.
Site Data. Buyer represents and warrants to Servicer that it has furnished all Site Data to Servicer as described in Exhibit D to Part A of the Agreement. Servicer may assume that such Site Data furnished by Buyer are accurate, truthful and complete, and that they match the real conditions of the Site. Otherwise, Seller shall be entitled to an equitable adjustment in the Contract Price in order to cover the reasonable documented costs incurred in connection with the transportation, installation, start-up and testing and the Servicer shall be entitled to to an equitable adjustment in the Programme and the Services Warranties furnished pursuant to this Part B of the Agreement.
