The Single Source Procurement clause allows an organization to procure goods or services from a specific supplier without engaging in a competitive bidding process. This clause typically applies when only one supplier is capable of meeting the technical, quality, or delivery requirements, such as when a product is proprietary or urgently needed. Its core function is to streamline procurement in situations where competition is impractical or impossible, thereby saving time and ensuring continuity of operations.
Single Source Procurement. (a) The City hereby waives all requirements for competitive bidding for the purchase of all Public Garages and the construction of all Public Improvements, and hereby approves the Redeveloper, its successors and permitted assigns as a single source from which all Public Improvements may be purchased or acquired and/or construction services related thereto may be obtained, and by its execution of this Agreement, the City confirms that the Common Council has approved the Redeveloper, its successors and permitted assigns as such single source.
(b) Redeveloper shall make available for review by a third party financial consultant of the City from time to time upon reasonable advance notice to the Redeveloper financial statements of the Redeveloper.
(c) Subject to the safety requirements reasonably imposed by the Redeveloper’s Construction Manager(s) and provided that such inspections do not interfere with construction, DPW shall be entitled to monitor and inspect the construction of the Public Improvements as such construction progresses.
