PRODUCTION SHARING SYSTEM SECTION FIVE – RECOVERY AS COST OIL Right to Recovery as Cost Oil The Contracted Party, in case of Oil and Gas Production, shall be entitled to receive, as Cost Oil, a share of the Oil and Gas Production, according to the terms, criteria, and conditions established in Annex V. Calculation and Recovery as Cost Oil T he expenditures below shall be recovered as Cost Oil, according to the methodology and procedures provided for in Annex V: expenditures previously approved by the Operating Committee or those which approval is waived by this Agreement; and expenditures recognized by the Manager. The expenditures below incurred by the Contracted Parties during the period prior to the execution of the Agreement and until creation of the Operating Committee may be recovered as Cost Oil and as long as, cumulatively: directly related to the collection of data and information, acquisition of governmental licenses, authorizations, and permits; subject to recovery, pursuant to the criteria provided for in Annex V; and ratified by the Operating Committee, prior to their actual recovery as Cost Oil. T he compensation due, as Cost Oil, to the Assignee for the expenditures incurred in Exploration and Production in the Co-participated Area, shall be recoverable up to the Effective Date of the Co-participation Agreement, under CNPE Resolution No. 02/2019 and as defined in MME Ordinance No. 213/2019, pursuant to sub-items “a” and “b” of paragraph 5.2. Recovery as Cost Oil Expenditures to be recovered as Cost Oil shall be registered in proper account, referred to as Cost Oil account. During the Production Phase, the Contracted Party shall, every month, receive the Production share corresponding to the Cost Oil, observing the limit of the Gross Production Value of the Production Sharing Agreement defined in Annex VI. Costs that exceed the limits defined and are not recovered as Cost Oil at a certain calendar year shall be accrued for appropriation in the subsequent years. Expenditures recognized as Cost Oil shall be annually adjusted preferably according to the Extended National Consumer Price Index (IPCA) of the Brazilian Institute of Geography and Statistics – IBGE, or according to another index that better reflects the industry expenditures, at the Manager’s discretion, and return on equity is prohibited. Motive power installations requiring 3 H.P. or more in the aggregate will be supplied only at 415 Volts, 3 Phase. No load will be normally permitted to be connected between two of the three phases of the three-phase supply.
Single Phase. Self Testing Refresher Course, required by employees to enable them to complete the necessary Quality Assurance, testing and Certificate of Compliance forms. New employees must undertake this course at the next available course date. Note: Employees who fail to obtain these requirements (listed under 14.6.1 – 14.6.4) within three (3) months of the start of this Agreement or within three (3) months of a new Employee starting with the Company will result in those Employees forfeiting the flat on-site allowance ($2.50 hr) until such time as the requirements are met.

  • Preconstruction Phase The Preconstruction Phase shall mean the period commencing on the date of this CM/GC Contract and ending upon commencement of the Construction Phase; provided that if the Owner and CM/GC agree, the Construction Phase may commence before the Preconstruction Phase is completed, in which case both phases shall proceed concurrently, subject to the terms and conditions of the Contract Documents.

  • Construction Phase Fee Contractor’s Construction Phase Fee is the maximum amount payable to Contractor for any cost or profit expectation incurred in the performance of the Work that is not specifically identified as being eligible for reimbursement by Owner elsewhere in this Agreement. References in the UGSC to Contractor’s “overhead” and “profit” mean Contractor’s Construction Phase Fee. The Construction Phase Fee includes, but is not limited to, the following items:

  • Development Phase contractual phase initiated with the approval of ANP for the Development Plan and which is extended during the Production Phase while investments in xxxxx, equipment, and facilities for the Production of Oil and Gas according to the Best Practices of the Oil Industry are required.
