Single Adjudicator Clause Samples

The Single Adjudicator clause establishes that any disputes arising under the contract will be resolved by one appointed adjudicator rather than a panel or multiple adjudicators. In practice, this means that both parties agree to submit their case to a single neutral individual, who will review the evidence and make a binding or interim decision. This approach streamlines the dispute resolution process, reduces costs, and ensures a faster outcome by avoiding the complexities and delays associated with multi-member tribunals.
Single Adjudicator. Both parties to the adjudication may agree to the appointment of a single adjudicator. A single adjudicator shall have the same powers, duties and responsibilities as an Adjudication Board. The fees and expenses of a single adjudicator shall be equally cost- shared by both parties to the adjudication.
Single Adjudicator. The proceeding shall be conducted before a single Adjudicator, selected by mutual agreement of the parties, who is a reputable intellectual property attorney or retired judge with experience in patents in relevant computer technology and having no conflicts of interest with either of the parties or their attorneys, and who has agreed to serve and whose compensation has been agreed upon by the parties.
