Significant Impact. The Participant must notify the Department Representative within 10 Business Days of any proposed action or event, including actions proposed or undertaken by a third party, which: are under the control or subject to the authorisation of the Participant; or are made aware to the Participant; and could have a Significant Impact upon the environmental values and/or conservation values of the Land. The obligations of the Participant under this Agreement are legally binding on any person who is a successor to the whole or any part of any interest that the Participant has in the Land or any part of the Land. For the avoidance of doubt and notwithstanding clause 7(a), section 307(c) of the EPBC Act applies to this Agreement.
