Common use of Short Sale Clause in Contracts

Short Sale. Prior to the third (3rd) anniversary of the Closing Date, the Shareholder shall not, directly or indirectly, enter into a short sale of OHGI Common Stock or enter into any hedging transaction including any borrowing which establishes a net short position.
