Shipment Commitment. To the extent the volume of Biomass produced from the Source Plant in a Contract Year exceeds the volume of Biomass that the operator of the Wilmington Terminal notifies Customer the Wilmington Terminal is capable of handling in such Contract Year, Customer shall cause all such excess Biomass to be delivered into the Terminal; provided, however, that the terms of this Agreement shall not apply to any volumes of Biomass produced from the Source Plant that are sold to Enviva, LP (or any of its Affiliates).
Shipment Commitment. Customer shall cause all Biomass produced from the Source Plant to be delivered into the Terminal, provided, however, that the terms of this Agreement shall not apply to any Biomass produced from the Source Plant and sold pursuant to that certain Biomass Fuel Supply Confirmation No. 1 dated the Effective Date under the Master Biomass Purchase and Sale Agreement between Customer (as “Seller”) and Enviva, LP (as “Buyer”).
