Sharing in Overtakes Sample Clauses

Sharing in Overtakes. If, as permitted by applicable contracts and laws, Working Interest Owner takes a greater share of the Gas produced from a Subject Well than the share of Gas which Working Interest Owner is entitled to take by virtue of ownership of the Subject Interests (such shares determined without regard to the existence of the Production Payment), then Production Payment Owner shall be entitled to share in such overproduction with Working Interest Owner in the same percentages that they share in the normal production from such well (i.e., the production to which they are entitled without regard to such overproduction).
