SEVERABILTY. In the event any portion of this Contract shall be finally determined by a court of competent jurisdiction to be invalid or unenforceable, such provision shall be deemed void and the remainder of the Contract shall continue in full force and effect.
SEVERABILTY. If any term or provision of this Contract is declared by a court of competent jurisdiction to be illegal or in conflict with any law, the validity of the remaining terms and provisions will not be affected. The Parties agree to attempt to substitute for any illegal or unenforceable provision a valid or enforceable one that achieves the economic, legal and commercial objectives of the illegal and unenforceable provision to the greatest extent possible.
SEVERABILTY. Each provision of this Agreement, including an exclusions or limitations of liability, shall be construed separately, applying and surviving even if for any reason any provision in this Agreement is held to be inapplicable or unenforceable under any circumstance.
SEVERABILTY. If any of the provisions of this agreement are found to be invalid or unenforceable for any reason, it will not affect any of the other provisions of this agreement and all of the other provisions will remain in effect as if the invalid or unenforceable provision or provisions had never been contained in the agreement.
SEVERABILTY. Should any part or provision of this Agreement be held unenforceable or in conflict with the applicable laws or regulations of any jurisdiction, the invalid or unenforceable part or provision will be replaced with a provision which accomplishes, to the extent possible, the original business purpose of such part or provision in valid and enforceable manner, and the remainder of the Agreement will remain binding upon the Parties hereto.
SEVERABILTY. The invalidity or unenforceability of any provision of this agreement shall not affect the validity or enforceability of any other provision of this agreement, and each other provision of this agreement shall be severable and enforceable to the extent permitted by law.
SEVERABILTY. If any section or part of this Agreement is held by a court to be invalid, such holding shall not affect the validity of any other part of this Agreement.
SEVERABILTY. If any provision of these PO Terms and Conditions shall be determined by a court of competent jurisdiction to be invalid, illegal, or in any manner unenforceable, such determination shall not affect or impair the validity, legality, or enforceability of the remaining provisions.
SEVERABILTY. 11.1 It is further agreed that the Employer and the Union will comply with all applicable federal, state and municipal laws. Any rules and regulations issued pursuant thereto which are conflicting with the provisions of this Agreement will be mutually reviewed by the parties. Should any part of this Agreement be declared in conflict with any law or regulation, local, state or federal, the remainder of this Agreement shall not be affected and remain in force.
SEVERABILTY. This Agreement is intended to be performed with and only to the extent permitted by, all applicable Federal, State, County, municipal and local laws, statutes, ordinances, directives, orders, regulations, requirements, restrictions and rules. If any provision of this Agreement or the application thereof by any person, entities or circumstance, shall for any reason and to any extent be invalid or unenforceable the remainder of this Agreement and the application of its provisions to other persons, entities or circumstances shall not be affected thereby, but rather shall be enforced to the greatest extent permitted by law.
