New Relic certifies that it understands the restrictions set out in this Section 5.3 and will comply with them.

Service provider certification. TAP shall not: (a) Sell or Share the Personal Information; (b) retain, use, or disclose the Personal Information for any purpose other than for the Business Purpose, including to retain, use, or disclose the Personal Information for a commercial purpose other than providing its Services under the Agreement unless permitted by the Applicable Laws; (c) retain, use, or disclose the Personal Information outside of the direct business relationship between the TAP and Customer; (d) process the Personal Information for targeted and/or cross context behavioral advertising; (e) combine Personal Information with any other data if and to the extent this would be inconsistent with the limitations on service providers under the Applicable Laws. TAP certifies that it understands the restrictions set out in this Section 4.3 and will comply with them.
Service provider certification. 5.1 For the purpose of this Section, ‘Business’ has the meaning given in the CCPA; ‘Business Purpose’ means the Services provided under the Agreement; ‘CCPA’ means the California Consumer Privacy Act (Cal. Civ. Code § 1798.100 – 1798.199) and any and all corresponding regulations; ‘Consumer’ means a natural person who is a California resident; ‘Personal Information’ means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual resident or household in California; ‘Process’ or ‘Processing’ means any operation or set of operations that are performed on Personal Information or on sets of Personal Information, whether or not by automated means; ‘Sell’ has the meaning given in the CCPA; and ‘Service Provider’ means an entity that Processes Personal Information on behalf of a Businesses for a Business Purpose.
