Service Affecting Sample Clauses
The 'Service Affecting' clause defines what constitutes an event or issue that disrupts or impairs the normal operation of a service provided under the agreement. Typically, this clause outlines specific types of incidents—such as outages, significant performance degradation, or failures—that are considered to have a material impact on the service's availability or quality. For example, it may specify that any interruption preventing end users from accessing core features is deemed service affecting. The core function of this clause is to clearly identify which disruptions trigger certain contractual remedies, such as service credits or escalation procedures, thereby ensuring both parties understand when heightened responses or compensations are warranted.
Service Affecting. Service affecting maintenance trouble will be responded to within one hour (1) of trouble notification.

Service Affecting. 2.2.1 While exercising its right to first access, NEVADA should grant nondiscriminatory access to all occupants in or on its facilities and every effort should be made to accommodate as many occupants as is reasonably safe. Therefore, reasonable, simultaneous access will not be denied unless public or other safety considerations would prohibit such access.
2.2.2 Where simultaneous access is not possible, access will next be granted to occupants according to the level of damage to its facilities and the likelihood that damage will result in service disruption. Where likelihood that damage will result is not clearly discernible, access will be granted according to longevity in/on the structure (i.e., first in time, first in right).
2.2.3 Where longevity in the structure cannot be ascertained, access will be prioritized a first come, first served basis.
Service Affecting. A “Service Affecting” issue or dispute shall mean that such issue or dispute, unless resolved, places a Party’s End User Customer in immediate or imminent risk of not being able to use the service to which that End User Customer subscribes.
