Separate Plan Sample Clauses

The Separate Plan clause establishes that a specific plan or agreement is to be treated independently from other related plans or agreements. In practice, this means that the rights, obligations, and administration of the plan covered by this clause are not affected by the terms or performance of any other plan, even if the parties are the same. This separation helps prevent confusion or unintended overlap between multiple agreements, ensuring that each plan is interpreted and enforced on its own terms.

If the Employer elects the Pro Rata Allocation Method, the first amounts allocated under the Pro Rata Allocation Method will be deemed to be the Safe Harbor Nonelective Contribution as required under the 401(k) plan Agreement. To the extent required under the 401(k) plan Agreement, such amounts are subject to the conditions for Safe Harbor Nonelective Contributions described in subsections (2) – (4) below, without regard to any contrary elections under the Agreement.
