Common use of SEPARATE CONTRACTS TO XXXXXXX Clause in Contracts

SEPARATE CONTRACTS TO XXXXXXX. 5.12.1 If any part of CONTRACTOR'S WORK depends on proper execution or results of WORK performed by XXXXXXX or any separate CONTRACTOR, CONTRACTOR shall, prior to proceeding with the WORK, promptly report to PM/CM any apparent discrepancies or defects in such other WORK that render it unsuitable for such proper execution and results. Failure of CONTRACTOR so to report shall constitute an acceptance of XXXXXXX'X or separate CONTRACTOR'S WORK as fit and proper to receive the WORK, except as to defects which may subsequently become apparent in such WORK by others.
