Sellers's Default Clause Samples

Sellers's Default. In the event Sellers should fail to consummate this Contract for any reason except Purchaser's default, Purchaser may, at its option, either enforce specific performance of this Contract or terminate this Contract as its sole and exclusive remedy hereunder. If Sellers is unable to deliver title as required by this Contract, Purchaser shall have the right to take the Easement with whatever title Sellers can deliver. Nothing herein shall be construed to limit the Purchaser's right and power of eminent domain.
