Seller’s Retained Inspection Rights and Associated Costs. Pursuant to the terms of the Cyprus Creek and Xxxxxx #9 Lease and Sublease, the Cyprus Creek #9 Lease, the Xxxxxx #9 Sublease, and the Overriding Royalty Agreement, Seller has retained certain rights to inspect and/or examine the Buyer’s mine and records as more specifically described in the above referenced instruments. Without limiting any such rights, Seller hereby agrees that it shall bear its own costs and expenses associated with such inspections and/or examinations.
