Section 412. Upon receipt of a complaint of serious misconduct, at the Superintendent’s (or his/her 35 designee) discretion an employee may be placed on administrative leave, or assigned alternative 36 duties acceptable to the employee, until the District completes an investigation. Notification of a 37 suspension or recommendation for termination of employee will be provided to the employee in 38 writing prior to the implementation of such suspension or termination. 39 40 The cause(s) for the suspension or termination and the applicable time limit shall be stated in the letter 41 of notification. Suspensions may be with or without pay. A copy of any letters of discipline, 42 suspension, or termination, will be sent to the Union, unless the employee requests otherwise, in 43 writing. 44 45 A final recommendation for disciplinary action will be made to the Superintendent as promptly as 46 possible, but may be delayed by the complexity of the investigation, the involvement of outside 47 agencies, or the availability of witnesses. If the complaint is not substantiated by the investigation, 48 the record of the complaint will not be placed in the employee’s personnel file, or used in the 1 employee’s year-end evaluation. However, if additional information is subsequently received, the 2 investigation may be reopened and reinvestigated in light of the new information.
