Section 3 - Representation establishes the statements or assurances made by one or both parties regarding certain facts or conditions relevant to the agreement. Typically, this clause outlines what each party affirms to be true at the time of entering into the contract, such as having the authority to sign, ownership of assets, or compliance with laws. Its core function is to provide a basis for trust and accountability, ensuring that both parties can rely on the stated facts and have recourse if any representation proves to be false.
Section 3 - Representation. Nothing herein contained shall be construed to prevent any individual bargaining unit employee from presenting a grievance and having the grievance adjusted without the intervention of the Union if the adjustment is not inconsistent with the terms of the Agreement and the Union has been given an opportunity to be present at such adjustment. Any bargaining unit employee may be represented beginning at any level of this procedure by a representative of the Union. Upon request by either party hereto or of the bargaining unit employee or employees involved in a grievance, the latter may be present at any level of the grievance procedure.
Section 3 - Representation. All bargaining unit employees shall have the right of Union representation at each step of the grievance procedure, if they desire and the Union agrees. If a bargaining unit employee desires Union representation, and the Union agrees to represent the grievant, no grievant will be required to discuss any grievance if a designated Union representative is not present.
Section 3 - Representation. Any parties involved in a grievance procedure may be represented at any time during the procedures by a person or agent designated by a concerned party to act in its behalf.
