Section 22.3. 20 This agreement may be reopened and modified at any time during its term upon mutual consent of the 21 parties in writing; provided, however, that all State increases for classified salaries and benefits shall 22 be passed through for each year of this agreement. This agreement shall be reopened by mutual 23 consent as necessary to consider the impact of any legislation enacted following execution of this 24 agreement which may arguably affect the terms and conditions herein or create authority to alter 25 personnel practices in public employment.

Section 22.3. Physical Exam The Employer shall have the right to require the employee 26 to have a physical exam by a physician paid by the Employer resulting in the physician's 27 certification that the employee is unable to work due to the injury as a condition precedent to the 28 employee receiving any benefits under this Article. The designated physician's opinion shall 29 govern whether the employee is actually disabled ornot, but shall not govern whether the Employer 30 shall extend the period of leave.
Section 22.3. 14 Retroactive pay, where applicable, shall be paid in the case of retroactive pay resulting from negotiations 15 pursuant to Section 24.3, on the first regular pay day following the agreement, if possible.

Section 22.3 agreement may be reopened and modified at any time during its term upon mutual consent of the 20 parties in writing; provided, however, that all state increases for benefits and classified salaries shall be 21 passed through for each year of this agreement; and provided further, that all wage steps on 22 Schedule A will be increased by the K-12 legislative state mandated increase to wages for 2019-2020 23 and 2020-2021, or which ever is higher. Schedule A for 2018-2019 will reflect a 5.1 increase to 24 wages.
