Common use of Section 12 Clause in Contracts

Section 12. 1. The third sentence in Section 12.1 is hereby amended as follows: “In case such take over of the Supply Agreement Relating To Supply Of A OMEGA-3 Fatty Acid Concentrate (Omefas®) in Annex C will not take place on or prior to November 1, 2010 (the “Assignment Deadline”), both Parties shall have the right to early terminate the Agreement (see Section 19.2b) within thirty (30) days after the Assignment Deadline.”

Section 12. 1. The third sentence in Section 12.1 is hereby amended as follows: “In case such take over of the Supply Agreement Relating To Supply Of A OMEGA-3 Fatty Acid Concentrate (Omefas®) in Annex C will not take place on or prior to November January 1, 2010 2011 (the “Assignment Deadline”), both Parties shall have the right to early terminate the Agreement (see Section 19.2b) within thirty (30) days after the Assignment Deadline.”

Section 12. 1. The third sentence in Section 12.1 is hereby amended as follows: “In case such take over of the Supply Agreement Relating To Supply Of A OMEGA-3 Fatty Acid Concentrate (Omefas®) in Annex C will not take place on or prior to November March 1, 2010 2011 (the “Assignment Deadline”), both Parties shall have the right to early terminate the Agreement (see Section 19.2b) within thirty (30) days after the Assignment Deadline.”

Section 12. 1. The third sentence in Section 12.1 is hereby amended as follows: “In case such take over of the Supply Agreement Relating To Supply Of A OMEGA-3 Fatty Acid Concentrate (Omefas®) in Annex C will not take place on or prior to November 1, 2010 within one hundred eighty (the “Assignment Deadline”)180) days after closing of Financing Round A, both Parties shall have the right to early terminate the Agreement (see Section 19.2b) within thirty (30) days after the Assignment Deadlineend of such one hundred eighty (180) days period.”

The third sentence in Section 12.1 is hereby amended as follows: “In case such take over of the Supply Agreement Relating To Supply Of A OMEGA-3 Fatty Acid Concentrate (Omefas®) in Annex C will not take place on or prior to November July 1, 2010 2011 (the “Assignment Deadline”), both Parties shall have the right to early terminate the Agreement (see Section 19.2b) within thirty (30) days after the Assignment Deadline.”

Section 12. 1. Section 12. 1. The third sentence in Section 12.1 is hereby amended as follows: “In case such take over of the Supply Agreement Relating To Supply Of A OMEGA-3 Fatty Acid Concentrate (Omefas®) in Annex C will not take place on or prior to November 1September 30, 2010 (the “Assignment Deadline”), both Parties shall have the right to early terminate the Agreement (see Section 19.2b) within thirty (30) days after the Assignment Deadline.”
