Common use of Second Qualifying Event Clause in Contracts

Second Qualifying Event. The 18-month period (for Spouse and dependents) may be extended to 36 months if other events (e.g., divorce, legal separation, death, Medicare entitlement, or loss of dependent child status) occur during the initial 18-month period. If you become entitled to Medicare and within 18 months thereafter lose coverage due to a termination of employment, reduction in hours or failure to return to work after the end of an FMLA Leave period, your Spouse and/or dependent children will be entitled to continuation coverage for a total of 36 months from the date you become entitled to Medicare. The Qualified Beneficiary must notify the Plan Administrator of a second qualifying event in the manner and by the time set forth in paragraph (c) above.
