Common use of Second Payments Clause in Contracts

Second Payments. After the time period in Section 3.3 has run and prior to the cy pres distribution set forth in Section 3.7, Authorized Claimants who received and negotiated an initial payment pursuant to Section 3.5 will receive a second payment on a pro rata basis (i.e., by dividing the remaining funds in the Settlement Fund by the total number of Authorized Claimants that negotiated a payment pursuant to Section 3.5) to the extent such a payment is economically feasible (e.g., more than $5.00).
