Common use of SECA Duties Clause in Contracts

SECA Duties. Utilization of SECAs shall be in conformity with applicable statutes, Individualized Educational Programs, established guidelines and job description. SECAs are to assist in the instruction, behavioral, and personal care needs of students with disabilities in a school building in accordance with each student's IEP or 504 Plan. The expectation is that a SECA must be used to ensure all IEP and 504 Plan supports that are to be provided by a SECA are covered. A SECA may be used to provide class coverage if unforeseen circumstances arise, such as a student emergency, urgent student redirection, a scheduled substitute is delayed in arriving, or a personal care need of another staff member; however, this coverage shall be limited to the time necessary to resolve the circumstance. SECAs otherwise shall not be used to provide class coverage which takes away minutes provided to students with IEP or 504 Plans, except for temporary emergency supervisor duty. Emergency is defined as extraordinary events that are not anticipated which places students in jeopardy. SECAs shall not be used as a substitute teacher, to substitute for an absent Teacher Assistant or fill a Teacher Assistant vacancy, shall not be assigned office clerk duties and tasks, or school maintenance and operations tasks that otherwise do not relate to or assist in the instruction, behavioral, and personal care needs of students with disabilities in a school building. SECAs may be assigned the following duties if accompanying a student or students with a disability who require(s) supervision or support/services as specifically outlined in their IEP or if doing so does not impact the provision of IEP or 504 Plan supports: 1. Lunchroom duty; 2. General recess duty; 3. Hallway duty; 4. General supervision at the beginning or end of the school day; 5. Field trip monitor duties; 6. Safety Drills or Fire Drill monitor duties; and/or 7. Festival or Event participation. If a SECA is assigned to a specific student to provide dedicated support, that does not mean that the SECA cannot assist or be reassigned to other students with an IEP or 504 Plan if time remains in the SECA's schedule or if that particular student is absent on any given school day. At no time shall a SECA service a student without an IEP or 504 Plan for longer than sixty days without the student receiving an evaluation by the IEP team.
